    matters Experience The following are some of the matters Navinder has handled Shipping Cases A shipping case involving criminal breach of trust by an agent and abetment and conspiracy This matter was heard on appeal before the Chief Justice of Singapore wherein the accused was acquitted A 45 day trial in the Singapore High Court involving breach of fiduciary duties director s duties ship construction and negligence A case involving the carriage of goods and conversion of the same The case also touched on issues of agency of necessity and abandonment of cargo A case involving a marine cargo policy claim Navinder represented the insured who sued the insurers for the claim Proof of smuggling was a main issue which the insurers failed to prove An admiralty action involving the setting aside of an arrest of a vessel and damages for wrongful arrest for malicious non disclosure The case touched on whether jurisdiction was founded under Sections 3 1 1 and 4 4 of the High Court Admiralty Jurisdiction Act of Singapore An intricate shipping matter involving a scrutiny of the nature of a shiprepairer s possessory lien and the preservation of the same The case also dealt with the effect of an order for appraisement and sale of the vessel without an express reservation of possessory lienee s rights on the lien A long drawn shipping litigation involving the following issues Carriage of goods by sea and the manning requirement Obligation of shipowners to exercise due diligence Whether defendant shipowners breached their duty as bailees or carriers of cargo on board vessel Whether defendant shipowners could rely on defence under art IV of Hague Rules Carriage of Goods by Sea Act Cap 33 1998 Ed Schedule art III paras 1 2 art IV paras 1 2 Carriage of goods by sea and the obligation of seaworthiness Obligation of shipowners to exercise due diligence and whether defendant owners breached their duty as bailees or carriers of cargo on board vessel Whether defendant owners could rely on defence under art IV of Hague Rules Carriage of Goods by Sea Act Cap 33 1998 Ed Schedule art III paras 1 2 art IV paras 1 2 Whether the plaintiffs had title to sue defendant shipowners for damage to cargo on board vessel which ran aground Bills of Lading Act Cap 384 1994 Ed ss 2 1 5 2 Acting for a shipyard against an insurer involving the construction of various clauses of a shipconstruction shipconversion policy of insurance Builder s Risk An intricate shipping matter involving a scrutiny of the nature of a shiprepairer s possessory lien and the preservation of the same The case also dealt with the effect of an order for appraisement and sale of the vessel without an express reservation of possessory lienee s rights on the lien Acting for a major P I claim in relation to a Mare Del Nord type application and succeeded in setting aside an order made ex parte for the discovery and
